These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Palm Bay.

REQUEST FOR RELEASE OF FUNDS

On or about June 23, 2017, the City of Palm Bay’s Housing and Neighborhood Development Services (HANDS) division will submit a request to the U.S. Depart. of Housing and Urban Development (HUD) for the release of federal Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 (P.L. 93‑383) to undertake a project known as the ARC Park restroom construction project.

ASSESSED PROJECT

ARC Park – New Restroom Facility – Construction of a new restroom facility.  Location: 1381 Riviera Drive, NE, City of Palm Bay, FL. Est. CDBG funding: $70,000.

FINDING OF NO SIGNIFICANT IMPACT (FONSI)

The City of Palm Bay’s HANDS division has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Palm Bay’s HANDS division offices, 120 Malabar Road, S.E., Palm Bay, Florida 32907 may be examined or copied weekdays 8:30 A.M to 5:00 P.M.

PUBLIC COMMENTS

Any individual, group or agency may submit written comments on the ERR to City of Palm Bay’s HANDS division offices, 120 Malabar Road, S.E., Palm Bay, Florida 32907.  All comments received by June 22, 2017 will be considered by the City of Palm Bay prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION 

The City of Palm Bay HANDS division certifies to HUD that Gregg Lynk, Certifying Officer, in his capacity as City Manager, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the City of Palm Bay’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:  (a) the certification was not executed by the Certifying Officer of the City of Palm Bay; (b) the City of Palm Bay has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76), and shall be addressed to HUD at the Jacksonville HUD Field Office, Charles Bennett Federal Building, 400 West Bay Street, Suite 1015, Jacksonville, FL 32202-4410.  Potential objectors should contact HUD to verify the actual last day of the objection period.

PUBLIC NOTICE OF FUNDING AVAILABILITY FOR PUBLIC SERVICE ACTIVITIES

Community Development Block Grant Program (CDBG-PS) 2017-2018

The City of Palm Bay will accept applications for public service agencies for CDBG eligible activities for Fiscal Year 2017. The  City expects to have approximately $100,000 in CDBG Public Service funding available for fiscal year 2017-2018. Grants of up to $15,000 are available to local organizations through a Request for Proposal (RFP) application process. The CDBG Program’s primary objective is to provide funds to local programs that meet the identified needs of the 2016-2020 Consolidated Plan, and to improve the quality of life in low and moderate-income neighborhoods.

A Non-mandatory Technical Assistance Meeting for all prospective applicants will be held from 3:30 PM to 5:30 PM on Wednesday, March 22, 2017, in the City Council Chambers, 120 Malabar Road, SE, Palm Bay, FL.

A Second Technical Assistance Meeting will be held from 4:00 PM to 6:00 PM on Wednesday April 5, 2017, in the City Council Chambers, 120 Malabar Road, SE, Palm Bay, FL.

Applicants should plan to attend one of the technical assistance meetings.  The CDBG FY 2017 applications and information will be available during regular business hours at the address below, or on line at:

SUBSTANTIAL AMENDMENT TO ANNUAL PLAN
PUBLIC HEARINGS / PUBLIC DISPLAY / COMMENT PERIOD
COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)
& HOME INVESTMENT PARTNERSHIPS PROGRAMS

The City of Palm Bay has approximately $1.1 million in unexpended Community Development Block Grant (CDBG) funds which will be directed to new activities. The proposed activities will improve several local recreation facilties. Several activities previously identified in the FY 2015 and 2016 Action Plans will be modified or cancelled.

In addition, the City has $280,241.25 in the HOME Investment Partnership (HOME) program from the HOME Consortium. There is also approximately $100,000 in Program Income funds available. Funds will be redirected from Homebuyer Assistance to Reconstruction and Housing Rehabilitation to be undertaken by Habitat for Humanity. Downpayment Assistance will be continued to be funded for approximately $64,700.

The City of Palm Bay anticipates receiving approximately $700,000 in federal CDBG funds to operate the Community Development Block Grant (CDBG) program and $180,000 in the HOME Investment Partnership (HOME) program from Brevard County during FY 2017-2018. CDBG activities must primarily benefit low and moderate income families. The City will hold its Public Needs Hearing to hear your suggestions for funding activities using these funds. The City will make available the proposed Annual Action Plan for the FY 2017 program year for public display and comment for 30 days beginning on July 21, 2017. The Annual Plan outlines how the City intends to expend its Community Development Block Grant funds (CDBG) and HOME Investment Partnerships Program funds (HOME). In accordance with the federal regulations at 24 CFR, Part 91, the City of Palm Bay is required to prepare and submit an Annual Action Plan for its Housing and Community Development Programs.

PROPOSED AMENDED CITIZEN PARTICIPATION PLAN

Notice is hereby given by the City of Palm Bay that the Citizen Participation Plan (the Plan) for the City’s Community Development Block Grant (CDBG) and HOME Investment Partnerships Programs has been amended and is available for public review and comment.

In order to obtain the views of citizens, public agencies, and other interested parties, the City has placed its proposed Amended Citizen Participation Plan on public display for 15 days in the following location during regular business hours beginning on January 26, 2017:

In addition, the proposed Amended Plan is available for review on the City’s website at www.palmbayflorida.org.  PUBLIC DISPLAY NOTICE

FY 2014-2015 CONSOLIDATED ANNUAL PERFORMANCE
AND EVALUATION REPORT (CAPER) FOR
THE CITY OF PALM BAY, FL

Notice is hereby given that the City of Palm Bay, FL is obtaining public comments on the City’s Consolidated Annual Performance and Evaluation Report (CAPER) for FY 2014-2015. The CAPER document is one of the requirements under Title I of the National Affordable Housing Act of 1990, P.L. 101-625, for communities that receive a federal entitlement under the Community Development Block Grant (CDBG) Program, Home Investment Partnerships (HOME) Program, and/or Emergency Solutions Grants (ESG) Program.

The City will place the FY 2014-2015 CAPER document on public display for the period beginning on July 2, 2016 and ending July 16, 2016. The CAPER document may be found in the office of Housing and neighborhood Development Services (address below).

The purpose of the CAPER is to describe the level of assistance provided to low- and moderate-income persons and households through the various federal, state, and other non-federal funding resources during the City's 2014-2015 Program Year. The City intends to submit its 2014-2015 CAPER to the U.S. Department of Housing and Urban Development on or before July 19, 2016.

All interested persons are encouraged to provide comments on the City’s CAPER document and program performance until July 16th. Written comments should be directed to:
